Preamble

This site in its entirety is the property of the company BUZZ (“Buzz”), along with all related rights. Any reproduction, whole or partial, must be authorized by the owners. However, hyperlinks to the site are authorized without specific request.

1. Acceptance of Conditions

The customer acknowledges having read the specific sales conditions stated on this screen at the time of ordering, and accepts them explicitly and without qualification.

The present general terms of sale govern contractual relations between Buzz and its customers, with both parties accepting them without qualification. These general sales terms prevail over any other conditions in any other document, unless otherwise previously specified in writing.

2. Products and Delivery

The photographs illustrating our products are non-binding. In no case can Buzz be held liable for any mistakes in the photos. The majority of the products Buzz offers its customers are made to order and require production and delivery times that vary according to the product:

- 4 to 6 weeks (from the date the order is received and paid) for curtains, cushion covers and holdbacks

- 4 to 6 weeks for resin lamps

- approximately 3 weeks for items selected in the “Focus on designers”

If more time is needed (for example, if a textile or color is out of stock), Buzz will inform the customer and give the option of cancelling the order or receiving a reimbursement.

As the majority of the products Buzz offers are artisanal, there may be certain differences between the article and its photographic representation: colors in the photographs on the site are given as an example but are non-binding.

3. Ordering

Automatic registration systems are considered valid proof of the nature, content and date of an order. Buzz confirms receipt of an order in an e-mail sent to the address provided by the customer. A sale is only complete once the order has been confirmed and payment has been received. Buzz reserves the right to cancel any order from a customer with whom there is a dispute regarding payment of a previous order.

The information stated by the buyer when placing an order is binding:

- in case of a customer’s mistake concerning size, coloring or material, Buzz cannot be held liable

- in case of a mistake in the formulation of the recipient’s address, the seller cannot be held liable for any ensuing inability to deliver the product.

As the articles and products presented by Buzz are made individually to order, we cannot accept exchanges, returns or reimbursements for instances when the customer has changed his/her mind or is not satisfied with his/her order.

4. Delivery

Once an order is confirmed, Buzz commits to delivering to its carrier all the items ordered, after the article or product has been completed in accordance with the times indicated in paragraph 2.

For deliveries outside of metropolitan France, the customer is responsible for paying all import taxes, customs duties, value-added taxes, and all other taxes due according to the laws in the country where the order is received. All orders placed with Buzz are intended for the personal use of its customers; customers and end-users of our products are prohibited from reselling these products, in part or in whole.

Buzz is released from any legal responsibility if the customer does not pay the necessary taxes.

Delivery in metropolitan France will be made via La Poste in colissimo suivi. Any delays, in particular those that could be due to the carrier, do not give the buyer the right to demand damages or interest.

Deliveries in EEC countries are made via La Poste in colissimo suivi Europe. For deliveries outside of the EEC, deliveries are made via international postal services or other private company.

In cases of technical products, the customer will take care to verify the item functions properly upon delivery, and to read the instructions or safety precautions provided.

Buzz cannot be held liable for improper use of products or non-compliance with the recommendations for use.

In the case of major visible defects, the buyer has the right to return the product under the conditions stipulated in this document.

War, riots, fire, strikes, accidents and the impossibility of accessing supplies are considered cases of force majeure releasing the seller from its delivery obligation. Merchandise always travels at the risk of the recipient. Always check your package upon arrival. You have 48 hours to submit any exceptions with the carrier in the event of a missing or damaged item.

Due to availability, items in an order may be delivered in multiple deliveries. The customer will only pay for one delivery. If the customer would like to receive deliveries at two separate locations, s/he must place two separate orders, with the corresponding delivery charges.

5. Retraction

As stipulated in Article 3, because the items and products offered by Buzz are made to order, they can be neither exchanged nor reimbursed.

However, if a material, color, or product is unavailable, Buzz will offer the customer an alternative.

If the customer does not accept the alternative, the order will be fully reimbursed.

6. Prices

Prices are in euros.

Prices indicated on product sheets do not include shipping.

The price indicated in the order confirmation is the definitive price, with all taxes included (counting the VAT for France and EEC countries). These prices include the price of the products, the handling, packaging and storage of the products, and shipping and commissioning charges.

7. Payment

The price billed to the customer is the price indicated in the order confirmation sent by Buzz.

The amount is entirely payable the day of the definitive order.

Payment can be made with a bank card bearing the symbol CB.

Online with PayPal, you can pay via a bank server in a secure environment.

Your bank card number is sent to the bank’s servers and your payment is made directly to a bank in a secure environment without going through the shop’s server, giving a greater guarantee that your numbers are known only to our bank partner (Bred Banque Populaire).

An order confirmed by the customer will only be considered definitive when the concerned bank payment centers have given their approval. In the event said centers deny payment, the order will be automatically cancelled and the customer informed via e-mail. Buzz reserves the right to refuse any order from a customer with whom there is a dispute.

8. Disputes

The present contract is governed by French law. Buzz cannot be held liable for damages of any nature, material, immaterial or corporeal, which might result from malfunctioning or improper use of the products sold. Nor is Buzz liable for any modifications of products by the manufacturers. Under no circumstances will Buzz’s liability exceed the order amount nor will Buzz accept liability for simple mistakes or omissions that may arise despite all the precautions taken in the presentation of the products. In case of difficulties in implementing the present contract, the buyer has the opportunity, before taking any legal action, to seek an amicable resolution with the assistance of: a professional organization of the branch, a consumer association or any other counsel of his/her choice. Bear in mind that seeking an amicable resolution does not interrupt the "short time period" required by the legal warranty, the term of the contractual warranty. Bear in mind that as a general rule and subject to the Court’s assessment, honoring the provisions of the present contract concerning the contractual warranty supposes that the buyer honors his financial commitments to the seller.

Claims and disputes will always be received with goodwill, as good faith is always assumed in the customer who makes an effort to explain his situation. In case of dispute, the customer will first contact the company to obtain an amicable resolution.

Failing which, the Commercial Court of Paris holds sole jurisdiction, regardless of delivery location or method of payment accepted.

9. Warranty

Buzz guarantees that all products selected are made, produced or published in France.

In no case can Buzz be held liable for failure to comply with regulatory or legislative provisions in the country of receipt. Buzz’s liability is systematically limited to the value of the product in question, i.e. the value at the time of sale, without possibility of recourse against the brand or the company producing the product.

In any event, the customer benefits from a legal warranty against dispossession and hidden defects (Art. 1625 et seq. of the French Civil Code). Under the condition that the buyer presents proof of the hidden defect, the seller must legally repair all the consequences (Art. 1641 et seq. of the Civil Code); if the buyer goes to court, s/he must do so within a “short time period” from the discovery of the hidden defect (Art. 1648 of the Civil Code). 10. Legal Information

Providing personal information is necessary in order to complete online sales; this information is indispensable for the handling and shipping of orders and establishing invoices and warranty agreements. If information is not provided, the order will be cancelled. In accordance with the French Data Protection Act, handling of personal information concerning customers has been the subject of a declaration with the Commission Nationale de l'Informatique et des Libertés (CNIL). The customer has the right (Article 34 of the law of January 6, 1978) to access, modify, correct and delete data concerning him/herself, which s/he can exercise with Buzz. In addition, Buzz pledges not to communicate its customers’ information to a third party, either free of charge or in exchange for payment.
